Physician-Hospital Agreements

Fenton Nelson assists healthcare providers with review, negotiation, and drafting of medical directorship agreements.  Directorship and other supervisory contracts are required by law for hospital departments, skilled nursing facilities, imaging centers, and other healthcare facilities.

Typically, medical directorship agreements require physicians (or other healthcare providers) to exercise administrative oversight and supervisory responsibilities.  The medical director is required to to oversee, supervise the delivery of, and/or perform all of a particular category of services.  In addition, medical directorship agreement often require providers to perform other administrative responsibilities, For example, the medical director is often required to implement quality assurance and utilization management programs, supervise non-physician staff, prepare schedules and reports, and otherwise assist the facility in other respects.  In addition, some directorship agreements also require medical directors to ensure coverage of the particular department.  Many directors are responsible for providing qualified staffing on a 24/7, 365 day per year basis.

For healthcare facilities, Fenton Nelson assists in assessing directorship needs and ensuring that directorship agreements comply with legal requirements.  When representing directors, Fenton Nelson works to ensure that directorship agreements do not impose unrealistic requirements or hidden, under-compensated (or un-compensated) obligations.
